BLACKHAWK SKI CLUB 
WAIVER AND RELEASE OF LIABILITY 
AND 
ASSUMPTION OF RISK AGREEMENT

Each member of Blackhawk Ski Club, (the “Club”), individually, and on behalf of his or her minor children hereby agrees to the following terms and conditions:

As a member of Blackhawk Ski Club I agree to assume the risk of injury to person or property resulting from any of the dangers and risks of recreational, educational, and other activities occurring at the Club including, skiing and bicycling, known and unknown, and I RELEASE and DISCHARGE the Club, its Directors for any injury resulting from any of the dangers and risks of such recreational activities, including changing weather conditions, snow conditions, bare spots, rocks, stumps, trees, collisions with natural or manmade objects, or the activities of other persons, variations in terrain.

I further understand that by signing this agreement I acknowledge that Nordic, alpine and freestyle skiing, snowboarding, and mountain bicycling are HAZARDOUS. I understand and accept that falls and collisions do occur and injuries may result; therefore I assume the burden, and individual responsibility for myself and my minor children.

Furthermore, I accept all risk of injury, including but not limited to injury or death caused in whole or in part by the negligence or carelessness of the Club or its Officers, and/or Directors in the operation and management of the Club and in maintenance of the groomed and ungroomed surfaces, the surface tows, ski jumps, or bicycling trails and all other areas included within the Club property. As a member of the Club I agree and accept the responsibility of inspecting the facilities, equipment, trails, and tows and I understand that if I find anything is unsafe I will immediately advise the Club, a Director, or Ski Patrol Member of such condition and I shall refrain from participating until satisfied such condition is corrected.

I understand that the Blackhawk Ski Club is a private voluntary organization run by volunteer Officers and Directors who may have no special training or education in the creation, maintenance, and operation of a ski or mountain biking area. I also understand that at no time shall I allow non- Club members to use the ski tows or to ski or bicycle on any of the trails maintained on Club property.

I acknowledge that the Club offers a number of other activities and social events unrelated to skiing including, but not limited to camping, hiking, picnics, parties and other social events. My participation in any of these activities may involve danger resulting in injury and I agree that I participate in these activities at my own risk. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers, and Directors from all claims that arise from, or be in any way related, to these activities or events.

I understand that alcohol may be served or made available at functions held on Club property. I take full and unconditional responsibility for my own actions and the actions of my guests at any function that I may host on Club property. I further agree that I will not serve or provide alcohol to any person under the age of 21 at any time on Club property. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers and Directors from all claims or actions arising from any private function that I host on Club property.

I understand that occasionally members involved in activities and/or events may be photographed, videotaped or interviewed and thus these images, information or their competition results may appear on club web sites or be used in publicity, publications, and/or public relations activities. I agree to HOLD HARMLESS and RELEASE and DEFEND the Club, its Officers and Directors from all claims or actions arising from the use of these images or information.
